Robbery

Arizona statutes define robbery as taking another’s property by using or by threatening the use of force (Ariz. Rev. Stat. ┬ž13-1902). There are several types of robbery charges: aggravated robbery (robbery by more than one person), armed robbery (robbery with a real, implied or simulated weapon) and standard robbery. These are all felonies and conviction on any of these charges can mean prison time for a minimum of one year up to a maximum of several decades, depending on the defendant’s record and the nature of the robbery.

Robbery Law Firm in Phoenix

There are a number of defenses that can be used to fight robbery charges. I examine the case thoroughly to determine the course of action that best fits the client’s situation. Common defenses include:

  • Relationship between victim and defendant
  • Alleged weapon not actually used in a threatening manner
  • Miranda warnings not properly given by police
  • Illegal arrest or detainer
  • Search warrant not executed properly or otherwise unlawful search
  • Evidence not preserved correctly
  • Police reports not accurate

Because I am a former Maricopa County deputy prosecutor, I know the prosecutor’s tactics and know how to effectively defend the charges.
